Terms of service
1. General
1.1 Individual entrepreneur Ryskul Satybaldina (individual identification number (IIN): 860330450550), represented by the director Ryskul Satybaldina who acting on the basis of the Charter, hereinafter referred to as the “Seller”, places this Terms of service for the order delivery of the goods on Site
1.2 The placing of the order on Site is the Buyer's consent to the Terms of service, as well as the consent to accept and pay for ordered goods or/and their delivery to the Seller who delivered the order according to the conditions of the Terms of service.
1.3 There are following terms and definitions in the Terms of service:
- “Buyer” – person who has placed an order on Site;
- “Seller” - individual entrepreneur Ryskul Satybaldina (individual identification number (IIN): 861020350650);
- “Site” - arbapost.com;
- “Terms of service” - public offer of the Seller addressed to any person who wants to place an order delivery of goods according to the conditions indicated in the Terms of service, based on which the Seller delivers ordered goods;
- “Acceptance” - full and unconditional acceptance of the Terms of service by the Buyer;
- “Product” – products ordered by Buyer on Site;
- “Order” - a list of Products specified by the Buyer during checkout on Site;
- "Delivery" - the Seller's courier services which allow delivery of the order to the Buyer.
2. Subject
2.1 The Buyer places order of the delivery of products on Site, the Seller delivers the order to Buyer. The Buyer must pay for ordered products and/or for their delivery.
3. Order placing
3.1 Placing an order on Site Buyer agrees to the privacy policy;
3.2 To place the order the Buyer must create an account on Site. This account is required that Buyer can receive confirmation email and track of order processing after the order placing. The account must be created in 2 ways:
3.2.1 via sign in to Site with Google or Facebook account;
3.2.2 via account creating on this link.
3.3 The order placing on Site means the Buyer's consent to the Terms of service. The date of the transaction between the Seller and the Buyer is the date of the order placing on Site. The Buyer placing an order on Site agrees to the payment and delivery terms.
3.4 All information posted on Site is for reference and may convey information about certain properties and characteristics of the ordered products not fully, but this information will be updated on a regular basis to describe all required properties and characteristics about products.
4. Cancelation and return
4.1 The Buyer can cancel the order or part of the order at any time prior to the delivery of the order to the Buyer.
4.1.1 If the Buyer wants to cancel the order or part of order, he must to inform the Seller sending the message to [email protected]. The message must have the order number, which part of order or whole order must be canceled;
4.1.2 If the Buyer makes cancel whole order/part order prior sending it by Seller, the the Seller makes refund the cost of the order/part of the order and the cost of delivery of the order/part of the order.
4.1.3 If the Buyer makes cancel the whole order/part of the order after sending it by Seller, the Seller makes refund only the cost of the order/part of the order. The Buyer must send back the order/part of the order to the Seller and pay for its delivery. The seller makes refund during 7 days after receiving the order/part of the order. If the order/part of the order sent back by Buyer is damaged the refunding is not possible.
4.2 The Buyer can return the whole order/part of the order in case of defects. The Buyer must inform the Seller about defects sending email to [email protected] during 1 day after receiving the order.
4.3 Refunds is carried out within 3-10 business days depending on the payment system.
5. Delivery
5.1 The Seller delivers the Products based on the order placed by the Buyer on Site.
5.2 The delivery cost is included in the order cost and must be paid by the Buyer. The delivery cost is formed at the time of the order placement. The delivery cost depends on the location.
5.3 The Buyer must choose the location. The Buyer can choose it in 2 ways:
5.3.1 in the upper left corner on the main page;
5.3.2 during the order placement.
5.4 If the Buyer finds incorrect location was chosen in the personal account and/or in the confirmation email, the Buyer must send message about this to [email protected] as soon as possible. If the Buyer sends the email about the incorrect location:
5.4.1 before the Seller sends the order to the Buyer, then the Seller recalculate the delivery price. If the recalculated delivery price is more than the delivery price for the incorrect location, then the Buyer must pay for the extra delivery price. If the recalculated delivery price is lower than the delivery price for the incorrect location, then the Seller refund the change between 2 prices.
5.4.2 after the Seller sends the order to the Buyer, then the Buyer must pay extra for the delivery of the order from the incorrect location to the correct loaction if such delivery is possible or for the delivery of the order from the incorrect location to the Seller's distribution center plus delivery of the order from the Seller's distribution center to the correct location.
5.5 The ownership of the ordered Products, as well as the risk of its accidental loss or damage passes from the Seller to the Buyer at the time of delivery of the Products to the Buyer.
6. Price and payment
6.1 The price of each product is displayed on the Site.
6.2 If the ordered Product is not available, the Seller proposes the replacement of the missing Product. The Seller removes the cost of the missing product from the Buyer's bill in the absence of an alternative offer or if the Buyer doesn't agree with the replacement.
6.3 Payment for the Products and their delivery is made by the Buyer in USD.
6.4 The Buyer's obligations to pay for the order and its delivery are deemed fulfilled from the moment of receipt of funds to the Seller’s account.
7. Responsibility
7.1 The seller can transfer his rights and obligations to fulfill orders to the third parties.
7.2 Any claims must be resolved peacefully. The Buyer can send the claim to [email protected]. The claim must include a specific list of violations from the Seller, the number and date of the Order, the contact details of the Buyer who submitted the claim.
8. Validity
8.1 The agreement between Seller and Buyer according to the condition above enters into force from the moment of the order placement and is valid until the Parties fulfill their obligations fully.
8.2 The Seller is entitled to amend and/or supplement this Terms of service at any time without prior and subsequent notice to the Buyer. Any changes and/or additions take effect from the moment of its posting on the Site.
